Legal Bases - Contest March 2020

First.- OBJECT

The commercial entity CITY TIME BRANDS SLU, with NIF B-87080370, and registered office at Avda. Doctor Severo Ochoa, 47 - Alcobendas (Madrid), official distributor of ITEMPORALITY in Spain, organizes and manages this contest. From now on we will refer to CITY TIME BRANDS SLU as "ITEMPORALITY".

ITEMPORALITY organizes this contest in order to retain users of the profile of @ itemporality on the social network Instagram.

Second.- SCOPE

The territorial scope of this contest extends to the entire Spanish territory, except the Canary Islands and the autonomous cities of Ceuta and Melilla.

Third.- DURATION

This promotional action will be active from March 3 to March 8, both inclusive.

Fourth.- PARTICIPATION REQUIREMENTS

Participation in this contest is free.

Any natural person, over 18 years of age, resident in Spanish territory, who has their own profile on Instagram, may participate in the contest.

ITEMPORALITY staff of CITY TIME, or external companies related to it, as well as their relatives in the first degree of consanguinity / affinity may not participate in the contest.

All those who meet the above conditions will have the status of participant.

Fifth.- MECHANICS OF THE CONTEST

Participants, to participate in the contest, must follow the @itemporality account on Instagram and comply with the conditions of participation that will be indicated below, in the profile of @itemporality.

In ITEMPORALITY's official Instagram profile, the contest will be announced through a photo alluding to said contest. Those who want to participate must give "like" to the photo that announces the contest and answer the question: WOMEN'S DAY CONTEST. “Tell us who is the woman you most admire with the hashtag #MujerITEMPORALITY! Tag the two women who truly fascinate you and tell us why, there are sure to be many! The most original comment will be the #collar Cube Corazón Bicolor. Each participant can participate as many times as they want in the contest, as long as they tag different people.

Sixth.- PRIZE

The prize for this contest is the Cube Corazón Bicolor necklace, valued at € 29.- RRP.

The winner will have one week from the date the winner's name is communicated, counted from date to date, to contact ITEMPORALITY and confirm that they agree with the prize.

The award will be personal and non-transferable. It may not be the object of sale, exchange, alteration or compensation or assignment to third parties.

The winner will only have the right to enjoy the prize obtained and it is not possible to obtain any economic compensation for his resignation.

Seventh.- WINNERS

The election of the winner and the alternates will be held on March 9. A CITY TIME jury, made up of 3 members, will select the most original comment among all the participants who meet the conditions of participation provided in these rules. 1 winner and 3 substitutes will be chosen. ITEMPORALITY reserves the right to choose new substitutes until the award is delivered.

Once the winner has been chosen, ITEMPORALITY will proceed to communicate such condition through a direct message to the Instagram profile from which you have participated in the contest, after which the title of the post will be modified by putting "Contest closed" and the username of the winner. In said direct message, the winner will be informed of the instructions for obtaining the prize. The winner must follow the steps indicated by ITEMPORALITY staff to manage the delivery of their prize.

In the event that the winner does not reply to the direct message in which they are notified of their status as winner in the within 7 calendar days and if you do not communicate in your response that you want to receive the ITEMPORALITY product as a prize, you will lose the status of winner, the untimely response by who was chosen as the winner will not take effect. ITEMPORALITY will proceed to contact the alternates by direct message, at the order of election and following the previously established procedure.

ITEMPORALITY will be exempt from any liability that may arise from the impossibility of identifying the winners as a result of errors in the data provided by the winning participants. Participants are advised to verify their private messages section from the date the winner is chosen. ITEMPORALITY will not be responsible for any error in the awarding of the prize, provided that it is due to causes beyond its control or the lack of diligence of the winner.

Eighth.- PERSONAL DATA

In compliance with General Regulation 2016/679 on Data Protection (hereinafter, GDPR) and Organic Law 3/2018, of December 5, on Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), we inform you that the Personal data provided by the user will be the responsibility of City Time Brands, SLU The purpose of the treatment will be (i) to manage the contest as well as (ii) to achieve visibility of the ITEMPORALITY brand in the market.

The legal basis that enables the treatment is the user's consent to participate in the commercial action and to receive commercial information from City Time.

The data will be kept during the management of the commercial action or during the statutory limitation period of obligations in each case.

In no case is CITY TIME contemplated the transfer of data or the international transfer of personal data to third countries outside the EU. Nor will automated decisions be made without human intervention. We remind you of your right to file a claim with the Spanish data protection authority in the event that you consider that the current legal provisions on data protection have been violated.

As you are the holder of rights recognized in the current regulations on data protection, you can exercise the rights of access, rectification, opposition, limitation of treatment, portability and cancellation by contacting CITY TIME on AV street. DR. SEVERO OCHOA 47, 1ºB PQ EMP CASABLANCA II, 28100 or by ALCOBENDAS (MADRID) email through rgpd@citytime.es, in both cases indicating the subject RGPD.

We remind you that CITY TIME only wants to collect the personal data of the participants in the contest and, therefore, that it is the sole responsibility of the participant to obtain the prior express consent of third parties in the event that they were labeled or whose data personal data are used in the contest, as well as, to show evidence of said consent if necessary.

Ninth.- FISCAL TREATMENT OF THE PRIZE

In accordance with the regulations of the Personal Income Tax, the prizes awarded to citizens residing in Spain for participating in games, contests, raffles or random combinations are or are not linked to the offer, promotion or sale of certain goods, Products or services are subject to withholding and deposit on account as long as the retention base of the prize is greater than 300 euros. If the prize awarded to the winner exceeds 300 euros, CITY TIME will practice the retention and deposit on account of the corresponding prize and, in due course, will issue the appropriate certification that allows the winner to comply with their tax obligations by having to include in their Income tax declaration of the capital gain consisting of the award received, the amount that appears in the aforementioned certification of payment on account can be deducted as already entered. In order to carry out the retention and deposit on account, CITY TIME will need a photocopy of the winner's ID and that the winner signs a document justifying receipt of the prize at the time it is received. In the event of non-compliance with the above, the winner would lose their right to receive the prize.

In any case, the prizes received for participating in games, contests, raffles or random combinations, whether or not they are linked to the offer, promotion or sale of certain goods, products or services, constitute capital gains and must be taxed in the Tax on the Income of the Individuals of the recipient whatever its amount.

Tenth.- GENERAL

Participation in this contest implies full and total acceptance of these Rules by the participants. In the event of possible doubts in the interpretation of these Rules, the criteria of the organizers will prevail. Any statement to the contrary, that is, non-acceptance of the same, will imply the exclusion of the participant and, as a result of it, ITEMPORALITY will be released from the fulfillment of the obligation contracted with said participant.

ITEMPORALITY reserves the right to exclude those participants who made fraudulent use of the means of participation.

ITEMPORALITY reserves the right to modify these Terms and Conditions in the event that the concurrence of circumstances that could influence the objectivity and transparency of the contest is appreciated, justifiably.

Any incident that may arise and that is not reflected in these Rules will be resolved by ITEMPORALITY according to its knowledge and best criteria.

This contest is governed by Spanish law. ITEMPORALITY and consumers expressly submit to the jurisdiction and competence of the Spanish Courts and Tribunals in the terms of what is established in article 52.3 of the Civil Procedure Law.

This contest is not endorsed, administered or sponsored by Instagram, so the social network will be completely exonerated of all responsibility in this contest.
